By accessing or using FoodPic.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
These Terms constitute a legally binding agreement between you and FoodPic.ai regarding your use of our AI food photography services.
2. Description of Service
FoodPic.ai provides AI-powered food photography enhancement and generation services, including:
- Image-to-image food photo transformation
- Menu card scanning and dish extraction
- AI food image generation from text descriptions
- Image upscaling and background removal
- Export formatting for delivery platforms
3. Account Registration
To use our Service, you must:
- Be at least 16 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
4. Credits, Subscriptions, and Payment
4.1 Credit System
Our Service operates on a credit-based system. Credits are consumed when generating images or using premium features. Credit costs vary by operation type.
4.2 Subscriptions
Subscription plans provide monthly credit allocations and additional features. Subscriptions renew automatically unless cancelled before the renewal date.
4.3 Payments
- All payments are processed securely via Stripe
- Prices are in Euros (EUR) unless otherwise specified
- All prices include applicable VAT for EU customers
- Credits are non-refundable and non-transferable
- Unused credits do not roll over between billing periods
4.4 Refund Policy
Refunds may be granted at our discretion for service failures or technical issues. Contact support within 14 days of purchase for refund requests.
5. User Content and Intellectual Property
5.1 Your Content
You retain ownership of images you upload. By uploading content, you grant us a limited license to process, store, and display your content solely for providing the Service.
5.2 Generated Content
You own the AI-generated images created through our Service and may use them for commercial purposes, subject to these Terms.
5.3 Restrictions
You may not upload or generate content that:
- Infringes on intellectual property rights of others
- Contains illegal, harmful, or offensive material
- Depicts real individuals without consent
- Violates any applicable laws or regulations
- Attempts to deceive consumers or misrepresent products
6. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to reverse engineer or extract our AI models
- Circumvent usage limits or credit systems
- Share account credentials with third parties
- Use automated systems to access the Service excessively
- Interfere with or disrupt the Service or servers
- Resell or redistribute the Service without authorization
7. AI-Generated Content Disclosure
Images generated by our Service are created using artificial intelligence. While we strive for high quality, you should be aware that:
- Generated images may not perfectly match your actual products
- You are responsible for ensuring generated images accurately represent your offerings to customers
- Some jurisdictions may require disclosure of AI-generated content in advertising
- We recommend verifying generated images before use in marketing materials
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee:
- Uninterrupted or error-free service
- Specific results from using the Service
- That generated images will meet your requirements
- Compatibility with all devices or platforms
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOODPIC.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless FoodPic.ai, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
11. Termination
You may terminate your account at any time through your account settings. We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms.
Upon termination:
- Your access to the Service will cease immediately
- Unused credits will be forfeited
- We may delete your account data after 30 days
- Provisions that by nature should survive will remain in effect
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of the Netherlands.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
